The European Union (EU) has a complex but rigorously enforced food safety and labelling regime. Essentially EU legislation is harmonised across all EU Member States and product which is legal in one State can be sold in each and every State. Enforcement penalties vary but in UK offences for incorrect labelling or claims are £5000 ($7000) per offence, and there is provision for mandatory recall. Product is subject to Border Control and can be impounded on entry to UK. Storage costs for impounded goods are the responsibility of the importer and can run into many $000’s. The EU legal system is essentially different from the US. It is the responsibility of the manufacturer to ensure that product is compliant and there is no Government Approval process. Enforcement is retrospective and takes place after product is placed on the market. This means that the consequences of incorrect labelling are magnified.
